Discrimnación genética en materia de empleo en el Derecho internacional de los Derechos humanos

Abstract

El presente estudio tiene como finalidad el análisis del derecho a la no discriminación por motivos de carácter genético en el ámbito concreto del empleo. Para ello, comenzará con una breve explicación sobre los análisis genéticos, así como sobre la utilización de los resultados obtenidos por ellos en sectores ajenos al ámbito médico como es el sector laboral. Seguidamente, se expondrá el derecho internacional de los derechos humanos existente en esta materia para constatar la protección internacional otorgada, así como su protección por parte de distintos ordenamientos jurídicos internos. Finalmente, se analizará el concepto del derecho a la no discriminación para valorar la licitud de cláusulas que habiliten la discriminación genética en el empleo en determinadas circunstancias.

The purpose of this study is to analyse the right to non-discrimination on genetic grounds in the specific field of employment. To this end, it will begin with a brief explanation of genetic analyses, as well as the use of the results obtained by them in sectors outside the medical field, such as the labour sector. Next, the existing international human rights law in this area will be presented in order to verify the international protection granted, as well as its protection by different domestic legal systems. Finally, the concept of the right to non-discrimination will be analyzed in order to assess the legality of clauses that enable genetic discrimination in employment in certain circumstances.
