La mentira desde la perspectiva de la moral y del Derecho Penal

Abstract

La mentira es un concepto muy complejo de definir, y empezaremos haciéndolo gracias a autores clásicos. Es de vital importancia situar la mentira desde un plano filosófico y después ubicarla en el plano del Derecho. Como bien sabemos, hay una gran relación entre la moral y el Derecho. En este trabajo, me centraré en el Derecho Penal, descubriremos qué se entiende por mentira y cuál de ellas constituye un delito. A pesar de haber varios delitos relacionados con la mentira, me centraré en las injurias, y haré una pequeña referencia a las calumnias ya que ambos comparten el bien jurídico dañado, el honor. Para reforzar la información extraída, no solo me basaré en la Ley sino también en jurisprudencia. Para terminar mi trabajo, orientaré el tema que venimos estudiando en la actualidad, en especial, en las redes sociales. Cómo se producen las injurias en estas plataformas de Internet, además comprobar si las legislaciones actuales se adaptan o no a los avances en este campo, donde no haremos referencia sólo a España. Y finalmente, hablaremos de un fenómeno que se ha aumentado gracias a Internet, que es el de las Fake news y trataremos de ver si se considera o no delito.

Lying is a very complex concept to define, and we will start doing it thanks to classic authors. It is vitally important to situate the lie from a philosophical level and then place it on the level of Law. As we well know, there is a great relationship between morality and Law. In this work, I will focus on Criminal Law, we will discover what is meant by a lie and which of them constitutes a crime. In spite of the fact that there are several crimes related to lying, I will focus on the insults, and I will make a small reference to the slanders since both share the damaged legal good, the honour. In order to reinforce the information extracted, I will not only rely on the Law but also on case law. To finish my work, I will guide the subject we are currently studying, especially in social networks. How insults occur on these Internet platforms, and whether or not current legislation is adapted to developments in this field, where we will not refer only to Spain . And finally, we will talk about a phenomenon that has increased thanks to the Internet which is that of Fake news and we'll try to see if it's a felony or not.
