La persecución penal del “sexting” en el ordenamiento español: un estudio a través de la Sentencia 377/2018, de 23 de julio de la sala 2ª del Tribunal Supremo
Abstract
El objetivo principal de esta investigación consiste en examinar el nuevo delito tipificado en el artículo 197.7 del Código Penal tras la reforma por Ley Orgánica 1/2015 de 30 de marzo. Este estudio será realizado a través de la sentencia de la Sala 2ª del Tribunal Supremo 377/2018, de 23 de julio, mediante la cual se confirma la condena dictada por la Sección Segunda de la Audiencia Provincial de Valencia. Partiendo de los hechos probados acontecidos el 20 de noviembre de 2017, realizaremos una calificación jurídico penal de la conducta descrita con el objeto de determinar si es constitutiva del delito habitualmente conocido como "sexting", comprendido en el ámbito material del artículo 197.7 del Código Penal.
Los hechos originales de la sentencia han sido complementados con algunos hechos adicionales para analizar con mayor profundidad la conducta descrita y su calificación jurídico penal. The main objective of this investigation is to examine the new crime typified in the article 197.7 of the Criminal Code after the reform by Organic Law 1/2015 on the 30th of March. This study will be carried out through the decision of the 2nd Chamber of the Supreme Court 377/2018, on the 23rd of July, confirming the conviction handed down by the Second Section of the Provincial Court of Valencia. Based on the proven facts of November 20, 2017, we will make a criminal legal qualification of the described conduct in order to determine whether it constitutes the crime habitually known as "sexting", within the material scope of article 197.7 of the Criminal Code.
The original facts of the sentence have been complemented with some additional facts to analyze in greater depth the described conduct and its criminal legal qualification.
