dc.description.abstract | Ante el progresivo aumento de las diversas actividades que llevan a cabo las distintas formas que adoptan las personas jurídicas, y el crecimiento que estas han experimentado en diversos sectores que abarca su actividad durante los últimos años, se presentan como necesarios determinados mecanismos que controlen la actividad que estas desarrollan con el objetivo de evitar la posible comisión de hechos constitutivos de delitos por parte de estas. Con este propósito, se analiza jurídicamente la responsabilidad penal de las personas jurídicas, dando cuenta de su reciente origen y evolución normativa que ha experimentado y que paulatinamente ha configurado la regulación que actualmente se encuentra en el actual Código Penal español. Asimismo, se delimita la mencionada figura, determinando su fundamento en cuanto al sistema de imputación penal, y por otra parte, mediante el estudio de los supuestos que dan lugar a la responsabilidad penal en el caso de las personas jurídicas. Los dos niveles establecidos en el actual Código Penal, en relación con dicha responsabilidad, son analizados en atención a la última reforma llevada a cabo en 2015 para, posteriormente, centrarnos en los Programas de Cumplimiento o Compliance, cuyo precedente se encuentra en el sistema anglosajón, el cual se ha ido expandiendo por toda Europa. | es-ES |
dc.description.abstract | Given the progressive increase in the various activities carried out by the different forms adopted by legal persons, and the growth they have experienced in very different sectors that covers their activity in past few decades, certain mechanisms that control their activity are presented as necessary. These mechanisms are developed by Governments and other legal institutions with the aim of avoiding the possible commission of crimes by these legal entities. With this purpose, the legal responsibility of legal persons is analyzed legally, giving an account of their recent origin and normative evolution that they have experienced and that has gradually shaped the regulation that is currently found in the current Spanish Penal Code. Likewise, the aforementioned figure is defined, determining its basis in terms of the system of criminal imputation, and on the other hand, by studying the cases that give rise to criminal liability in the case of legal entities. The two levels established in the current Criminal Code, in relation to this responsibility, are analyzed in response to the last reform carried out in 2015, to subsequently focus on the Compliance or Compliance Programs, whose clearest precedent is found in the AngloSaxon system, which has been expanding throughout the European Countries. | en-GB |
