dc.description.abstractLa finalidad de este trabajo es analizar la situación actual del derecho a la intimidad, con el fin de determinar si se encuentra o no debidamente protegido en España. A tal fin, se examinan los principales retos que amenazan este derecho fundamental, en especial procedentes del desarrollo de los medios de comunicación y de las nuevas tecnologías, contemplados en su mayoría en la reciente Ley Orgánica 3/2018 de protección de datos y garantía de los derechos digitales. Además y con el objetivo de determinar la eficacia y el alcance de la tutela judicial dispensada para su protección, se estudia la reciente doctrina del Tribunal Constitucional y del Tribunal Supremo en las distintas vertientes de la materia. Finalmente, se concluye que los titulares del derecho a la intimidad gozan de una adecuada protección merced a la doctrina jurisprudencial de ambos Tribunales, a las actualizaciones legislativas del Estado español y a las procedentes de U.E.es-ES
dc.description.abstractThe aim of this dissertation is to analyse the current state of affairs with regards to privacy-related rights, with the purpose of determining whether these are appropriately protected in under Spanish Law. To achieve this, the main challenges when it comes to preserving these rights are subject to examination. These threats are particularly impacted by the development of media communications and new technologies and are almost entirely considered in the New Organic Law 3/2018 on data protection and digital bill of rights. Moreover, with the purpose of achieving a better understanding of the effectiveness and the extent of the guardianship nowadays, the recent doctrine of the Constitutional Court and the Supreme Court in the different variations of this fundamental right is researched. All in all, it can be concluded that the holders of the right to privacy enjoy the adequate protection thanks to the doctrinal labour of both Courts, the legislative development of the Spanish State as well as those from the UE.en-GB
