El derecho de asilo en la Unión Europea: el reglamento de Dublín y su reforma

Abstract

En 2015 surge en Europa la mayor crisis de refugiados similar a la que se vivió en nuestro continente durante la Segunda Guerra Mundial. En este contexto, se pone de manifiesto el fracaso del Sistema Europeo Común de Asilo y nace en la Unión Europea la necesidad de llevar a cabo la reforma de las medidas que en él se integran. Entre estas medidas destaca la siguiente: El Reglamento de Dublín III. El Reglamento de Dublín, que tiene como objetivo determinar el Estado Miembro responsable de examinar una solicitud de asilo, no está funcionando como se esperaba. Así las cosas, el presente trabajo tendrá como objetivo principal el análisis del Reglamento de Dublín III con el fin de detectar cuáles son sus principales fallos, determinar el porqué de su fracaso y estudiar la reforma que la Unión Europea pretende implantar para alcanzar el Sistema Europeo Común de Asilo con el que tanto lleva soñando.

In 2015 one of the biggest refugee crisis of all times took place in Europe. The Common European Asylum System resulted to be a total failure, which led the European Union to deeply consider that a reform of the rules that integrated the system should urgently be made. Of all the measures implemented, we would like to outline the following: The Dublin III Regulation. The Dublin Regulation, which is responsible for determining which European Member State is responsible for examining each asylum application, is not working as it should. Therefore, this research project aims to analyse The Dublin III Regulation as to determinate which are its major downfalls, the reason why it is not working and the reform the European Union is willing to carry out as to achieve the Common European Asylum System which they have always dreamt of.
