Sistema electoral español : Derecho comparado y posibles reformas

Abstract

La Ley Electoral es un elemento clave a la hora de configurar el sistema de partidos, y, en consiguiente, afecta a la configuración parlamentaria del Congreso de los Diputados. El sistema electoral no solo afecta de manera directa a la calidad democrática de un país, sino que también determina la facilidad para formar un Gobierno estable. De hecho, estos son los objetivos de todo sistema electoral, gobernabilidad y representatividad. Desde este marco se construirá una propuesta de reforma en la que se atajen los principales defectos actuales del sistema español. De un lado, la fuerte desigualdad en el valor del voto entre regiones ya que en determinadas circunscripciones el valor del voto puede triplicar el de otras. De otro lado, el segundo defecto identificado es la falta de proporcionalidad existente en aquellas circunscripciones electorales pequeñas, aquellas que tienen asignados 2, 3 o 4 Diputados ya que, en ellas, los partidos minoritarios no traducen los votos recibidos en ningún tipo de representación. En definitiva, se pretenden corregir estos dos defectos respetando el principio de gobernabilidad y de representatividad.

The electoral law is a key element in order to build the political parties’ systems, in consequence, it affects the Parliament´s configuration of the Congress of Deputies. The electoral system does not only affect to the democratic quality of a country, but it also determines the ease to constitute a stable government. In fact, the goals of any electoral system are governability and representativeness. From these goals, a reform proposal that tackles the main defects of Spanish electoral system is going to be built. On the one hand, the high inequality in terms of vote power between regions because in some of them, the power of voting can triple others. On the other hand, the second identified defect is the lack of proportionality in small constituencies (those with 4 or less Members of the Parliament assigned); voting a minority political party doesn´t lead to any representation. In conclusion, there is the intention of correcting the existing defects of the system by taking into account governability and representativeness.
