La carga de la prueba en el proceso penal
Abstract
El estudio de la carga de la prueba se inicia con el concepto moderno de carga procesal para comprobar que lo que resulta aplicable en el orden civil, deviene aplicable al proceso penal. Sin embargo, la gran diferencia reside en que la regla básica de la carga de la prueba en el proceso penal la constituye el principio de presunción de inocencia. Así, desde una perspectiva doctrina y jurisprudencial se estudia cómo afecta dicho principio al tratamiento del encausado durante el proceso y a la manera en que debe desarrollarse la actividad probatoria. Asimismo, no sólo se da respuesta al sentido de la sentencia de los Jueces y Tribunales cuando no alcancen convencimiento pleno acerca de la culpabilidad del acusado –regla de juicio –, sino también a la atribulación de la carga de la prueba de los hechos delictivos– regla de conducta –. The study of the burden of proof begins with the modern concept of procedural burden to verify that what is applicable in the civil order becomes applicable in a criminal proceeding. However, the major difference is that, in a criminal proceeding, the basic rule regarding the burden of proof is the principle of presumption of innocence. Thus, from a doctrinal and jurisprudential perspective, both the manner in which this principle affects the treatment of the accused during the criminal procedure and the way in which the evidentiary activity should be carried out will be studied. In addition, it not only responds to the meaning of sentencing provided by Judges and Courts when they are full certain the culpability of the accused, but also to the attribution of the burden of proof of criminal acts.
