dc.description.abstract | El presente trabajo de investigación parte de la distinción entre el arbitraje nacional y el arbitraje internacional. Califica el arbitraje como la fórmula heterocompositiva de resolución de conflictos, alterna a la vía judicial y en la que juega un papel importante la autonomía de la voluntad de las partes. A nivel internacional, distingue entre las diferentes modalidades de arbitraje. Concretamente, analiza el arbitraje comercial, el más usual, el arbitraje de inversiones, en pleno auge, el arbitraje de consumo, el cual resuelve los conflictos entre consumidores y empresas, y el arbitraje obligatorio, modalidad que la ley impone a las partes. Se detiene a analizar las distintas coordenadas que catalogan al arbitraje internacional, las fuentes de las que emanan las normas internacionales, las instituciones de arbitraje que sirven de apoyo y sustento para la resolución del procedimiento arbitral, y la especial acción de anulación del laudo arbitral. | es-ES |
dc.description.abstract | This research work starts from the distinction between national and international arbitration. It describes arbitration as the heterocompositive formula for the resolution of conflicts, alternating the judicial route and in which the autonomy of the will of the parties plays an important role. At the international level, it distinguishes between the different forms of arbitration. Specifically, it analyzes commercial arbitration, the most usual, investment arbitration, which is booming, consumer arbitration, which resolves conflicts between consumers and companies, and compulsory arbitration, a modality that the law imposes on the parties. It analyzes the different coordinates that classify international arbitration, the sources from which international norms emanate, the arbitration institutions that serve as support and sustenance for the resolution of the arbitration procedure, as well as the special action for annulment of the arbitral award. | en-GB |
