El tratamiento de la víctima en el proceso penal español

Abstract

El trato institucional hacia la víctima en el proceso penal ha ido cambiando a lo largo de la historia. De encontrarse en una posición privilegiada, pasó a ser la gran olvidada del proceso penal en beneficio del delincuente, que vio como sus derechos eran cada vez menos vulnerados. A lo largo de este trabajo se analizará el trato que recibe la víctima al verse involucrada, en contra de su voluntad, en el proceso penal. Se llevará a cabo un estudio legal, jurisprudencial y doctrinal, para concluir cuál es la posición de la víctima en el proceso penal español en la actualidad.

The institutional treatment of victims in criminal proceedings has changed throughout the history. From being in a privileged position, the victim became the great neglect of the criminal process for the benefit of the offender, who saw his rights increasingly more protected. Throughout this work, we will analyze how the victim is treated when he or she is involved, against his or her will, in the criminal process. A legal, jurisprudential, and doctrinal study will be carried out to conclude what the position of the victim is in the current Spanish criminal proceeding.
