El tratamiento procesal de la víctima y sus tendencias actuales

Abstract

Este trabajo está centrado en analizar una figura que tantas décadas ha pasado desprotegida, la víctima. De este modo, se detallará su proceso hasta convertirse en una figura protagonista en nuestro sistema legal. Dicho análisis constará de cinco partes dónde se explicarán sus derechos, su regulación, sus medios de protección, los métodos de resolución de conflictos y su intervención en el proceso penal. Todo ello, siempre acompañado por la Ley 4/2015, de 27 de abril, del Estatuto de la víctima del delito, creada para conseguir una protección generalizada de todas las víctimas de un hecho ilícito. Finalmente, se intentará dar un enfoque actual, al analizar las diferencias y analogías de dos tipos de víctimas muy presentes en nuestros días: las víctimas de violencia de género y las víctimas de violencia doméstica.

This work is focused on analyzing a figure that has been so many decades unprotected, the victim. In this way, it will be detailed its process until it has become a protagonist figure in our legal system. This analysis will consist of five parts explaining their rights, their regulation, their means of protection, the methods of conflict resolution and their intervention in the criminal process. All this will always be accompanied by the Law 4/2015 of 27 April on the Statute of the Crime Victim, created to achieve a generalised protection for all the victims of an illegal act. Finally, an attempt will be made to give a current approach by analysing the differences and analogies of two types of victims which are very present today: victims of gender violence and victims of domestic violence.
