La nulidad de las adopciones internacionales : distinción con figuras jurídicas similares

Abstract

El presente trabajo estudia la nulidad de las adopciones internacionales, así como la distinción de la nulidad de la adopción con figuras jurídicas similares: la exclusión de efectos y la extinción. Para llevarlo a cabo, se ha realizado un análisis inicial centrado en la constitución de la adopción, sus requisitos esenciales y el procedimiento a seguir. Posteriormente se han estudiado los distintos casos en los que la adopción puede ser declarada nula. Para ello, se ha acudido a distintas fuentes, como obras doctrinales, legislación estatal e internacional y la jurisprudencia existente en este tema. La conclusión a la que se ha llegado es que la nulidad de una adopción internacional, dado los efectos que tiene sobre el menor, debe ser regulada minuciosamente, protegiendo en todo momento el interés superior del mismo.

The present paper studies the nullity of international adoptions, as well as the distinction of the nullity of adoption with similar legal figures: the exclusion of effects and the extinction. To carry it out, an initial analysis has been done focused on the constitution of the adoption, its essential requirements and the procedure that must be followed. Subsequently, the different cases in which the adoption can be declared null have been studied. For this, different sources have been used, such as doctrinal works, state and international legislation and the existing jurisprudence in this topic. The conclusion reached is that the nullity of an international adoption, given the effects it has on the child, must be carefully regulated, protecting at all times the best interests of the child
