dc.description.abstract | Los contratos inteligentes son una modalidad de contratación digital que se caracterizan por ser autoejecutables por sistemas computacionales. Gracias a los recientes avances en Blockchain, tecnología que emplea como base, la contratación inteligente se presenta como una alternativa revolucionaria y transgresora. Por ello, la Doctrina se ha planteado la viabilidad y las ventajas que el sistema legal español podría obtener de estos contratos inteligentes. El objetivo del trabajo consiste en analizar la implementación y las alternativas legales tradicionales de los contratos inteligentes con el fin de aclarar su verdadera utilidad. En el presente trabajo explicaremos el concepto de contrato inteligente y sus posibles efectos en el ordenamiento jurídico español. Describiremos el recorrido histórico de la contratación digital y estudiaremos la tecnología que sirve de base a los contratos inteligentes. Asimismo, expondremos sus potenciales limitaciones y realizaremos un análisis jurídico del contrato. Finalmente, trataremos los futuros usos de los contratos inteligentes y su interacción con instrumentos legales tradicionales del ordenamiento jurídico español. | es-ES |
dc.description.abstract | Smart Contracts are a form of digital procurement that is characterized for being self-executable by computable systems. Thanks to the recent improvements on blockchain, technology that constitutes its basis, smart procurement is presented as a revolutionary and transgressive alternative. Therefore, the Doctrine has discussed the viability and advantages that the Spanish legal system could obtain from these smart contracts. The objective of present paper is to analyze the implementation and the traditional legal alternatives of the smart contracts in order to clarify their true utility. In this paper we will explain the concept of smart contracts and its possible effects in the Spanish legal system. We will describe the historical path of digital procurement and we will study the technology that serves as the basis for smart contracts. We will also expose its potential limitations and conduct a legal analysis of the contract. Finally, we will address the future uses of smart contracts and their interaction with traditional legal instruments of the Spanish legal system. | en-GB |
