La responsabilidad civil derivada del acoso escolar

Abstract

El objeto de este trabajo es el estudio crítico de lo que hoy en día conocemos como “acoso escolar” o “bullying” y las consecuencias que de éste derivan, entendido como un conjunto de conductas llevadas a cabo por un alumno o alumnos menores de edad sobre otro, basadas en humillaciones, burlas, vejaciones incluso agresiones físicas, llevadas a cabo de forma permanente o continuada, provocando en la víctima un desgaste tanto físico como moral y llegando a producirle al sujeto en ocasiones traumas y enfermedades psicológicas que en los supuestos más extremos han concluido, incluso, con el suicidio de la víctima.

En este trabajo analizaré la responsabilidad civil que este tipo de violencia genera y, al tratarse de menores de edad, quién responderá por los daños y perjuicios causados a la víctima. Asimismo estudiaremos las cuestiones controvertidas que el tema en cuestión conlleva apoyándome en la mayor jurisprudencia y doctrina posible.

The goal of this project is the critical study of what we know as bullying and the consequences of this type of harassment, understood as a set of behaviors carried out by one or more student underage based on humiliating, teasing and even beating another student in a continuous manner, causing the physical and mental deterioration of the victim and potentially generating him traumas and psychological diseases, that in the most extreme cases have ended up with the suicide of the victim.

In this project, I will analyze the civil responsibility of this type of violence, and who will respond to the damages caused to the victims, taking into account that we are talking about underage students. I will also analyze the controversial issues that the subject entails, based on jurisprudence and doctrine.
