dc.description.abstract | La práctica deportiva en nuestro país ha experimentado un crecimiento exponencial en los últimos años. Cualquier persona que practique un deporte sabe que existe la posibilidad de sufrir algún daño y, por ende, asume el riesgo que puede conllevar la práctica de dicho deporte. No obstante, esta asunción no debe actuar como un salvoconducto para justificar cualquier acción generadora de daños en el transcurso de una actividad deportiva. El presente trabajo ofrece una visión de los distintos tipos de responsabilidad que pueden ser aplicados en atención a las circunstancias concretas de cada supuesto. Asimismo, veremos cómo los Tribunales españoles han empleado, con motivo de la ausencia de una regulación específica en materia deportiva, la Teoría de la Asunción de riesgo como criterio general, cuyo matiz diferencial reside en la exoneración de responsabilidad. De esta manera, analizaremos los requisitos necesarios que amparan la asunción del riesgo, la delimitación de los riesgos que pueden ser asumidos y los efectos que tal asunción provoca en la esfera de la responsabilidad, y más aún cuando en la conducta dañosa productora del daño interviene culpa, negligencia o dolo. Por último, examinaremos las dificultades que deben afrontar los Tribunales a la hora de dictar las líneas de resolución, en tanto que los límites fronterizos que separan ambas esferas de responsabilidad se encuentran estrechamente ligados. | es-ES |
dc.description.abstract | The practice of sports in our country has experienced an exponential growth in recent years. Any individual who practices sports is aware of the possibility of suffering some damage and, therefore, assumes the risk that such sport may entail. However, this assumption should not act as a safeguard to justify any action generating damage in the course of a sporting activity. This paper offers an overview of the different types of liability that can be applied in light of the specific circumstances of each case. Likewise, we will see how the Spanish Courts have used, due to the absence of specific regulation in sports matters, the Theory of Assumption of Risk as a general criterion, whose differential nuance lies in the exoneration of responsibility. In this way, we will analyze the necessary requirements that shelter the assumption of risk, the delimitation of the risks that can be assumed and the effects that such assumption causes in the sphere of responsibility, especially when fault, negligence or willfulness intervenes in the harmful conduct that causes the damage. Finally, we will examine the difficulties that the Tribunals have to face when dictating the lines of resolution, taking into account that the borderlines separating the two spheres of responsibility are closely linked. | en-GB |
