La distribución de competencias en el Estado español : la Educación

Abstract

A través del presente trabajo de investigación el lector podrá indagar en la configuración competencial española, cuyo origen queda legitimado por la cesión de soberanía que realiza el pueblo español al Constituyente, siendo protagonizada principalmente por la relación Estado-Comunidades Autónomas. A través de ella, y apoyándonos en los principios de unidad nacional, autonomía y solidaridad, se pretende dar a conocer tanto el contenido constitucional como el desarrollo legislativo que conlleva la materialización de dicha atribución de competencias. Por otro lado, llamará especialmente la atención todo aquello referido al derecho a la educación, garantizado por el art. 27 CE y por tanto catalogado como derecho fundamental, caracterizándose principalmente por ser una competencia con facultades compartidas, tanto a nivel estatal autonómico. Esta particularidad, sumada a la relevancia de la educación como elemento clave por su incidencia en la ciudadanía, harán de esta materia la elegida para plasmar el mecanismo a través del cual quedan articuladas las relaciones competenciales en nuestro país: España. En este sentido, se realizará una revisión de la literatura existente, con el objetivo de construir el marco adecuado para ofrecer a nuestro lector la posibilidad de elaborar una opinión fundada y razonada sobre la materia objeto de estudio en dicha investigación.

Through this research work, the reader will be able to investigate the Spanish configuration of competence, whose origin is legitimised by the transfer of sovereignty by the Spanish people to the Constituent Assembly, mainly led by the State-Autonomous Communities relationship. Through it, and based on the principles of national unity, autonomy and solidarity, the aim is to make known both the constitutional content and the legislative development involved in the materialisation of this attribution of competences. On the other hand, everything referring to the right to education, guaranteed by art. 27 CE and therefore catalogued as a fundamental right, will call special attention, characterized mainly by being a competence with shared faculties, both at autonomous state level. This particularity, added to the relevance of education as a key element due to its impact on citizenship, will make this subject the one chosen to shape the mechanism through which competence relations are articulated in our country: Spain. In this sense, a review of the existing literature will be carried out, in order to allows the construction of the appropriate framework to offer our reader the possibility of elaborating a well-founded and reasoned opinion on the subject matter of study in said research.
