Justicia, ley y derechos desde la tradición kantiana

Abstract

Desde la concepción kantiana de Filosofía del Derecho se abordarán las diversas corrientes pensativas de los autores más influyentes. Siguiendo un orden temporal, se contrastará la visión de Kant acerca del Derecho, con la de Kelsen, Hart y Dworkin, entre otros. De esta manera, se ilustrará cómo no cabe concebir el Derecho como un fenómeno social aislado, sino más bien como una ciencia inexacta. Para ello, es esencial la correlación de las cuatro dimensiones del Derecho: formal, material, agente y valorativa. Cada una de ellas es necesaria para lograr alcanzar un equilibrio que garantice la convivencia pacífica y estable de las sociedades. Finalmente, se comparará con los acontecimientos sociales más recientes, con el objeto de ilustrar la importancia de estas cuatro dimensiones del Derecho.

From the Kantian conception of Philosophy of Law, the various thought currents of the most influential authors will be approached. Following a temporal order, Kant's vision of Law will be contrasted with that of Kelsen, Hart and Dworkin, among others. In this way, it will be illustrated how Law cannot be conceived as an isolated social phenomenon, but rather as an inaccurate science. For this, it is essential to correlate the four dimensions of Law: formal, material, agent and evaluative. Each one of them is necessary to achieve a balance that guarantees the peaceful and stable coexistence of societies. Finally, it will be compared with the most recent social events in order to illustrate the importance of these four dimensions of Law.
