La evolución del régimen de regalías en España
Resumen
El presente trabajo tiene como objetivo estudiar la evolución de las regalías en España. Se puede definir las regalías de dos formas: en primer lugar, como el derecho inherente a la Corona o al Estado y que le corresponde por el simple hecho de serlo; y, en segundo lugar, serán regalías todos aquellos privilegios, en materia eclesiástica, que otorgue el Sumo Pontífice a los monarcas españoles.
Igualmente, conviene destacar que se trata de una figura que siempre ha estado muy presente en la política española, puesto que al Estado siempre le ha interesado controlar la Iglesia, tanto en la vertiente económica como en la espiritual. Además el poder civil y el poder eclesiástico han estado siempre muy ligados, muchas veces entremezclados, y de allí surge el peso de las regalías.
Con la intención de cumplir con el objetivo planteado, esta investigación se ha desarrollado en siete partes. Se sigue un orden cronológico muy preciso, que es el siguiente: se comienza con en la Edad Antigua; se prosigue con la Edad Media; la época de los Reyes Católicos y los Austrias; el regalismo indiano; el regalismo borbónico; el regalismo carlista e isabelino del siglo XIX; y finalmente el siglo XX hasta la muerte de Franco. The objective of this paper is to study the evolution of regalities in Spain. Regalities can be defined in two ways: first of all, as the inherent right of the Crown or the State to which it is entitled simply because it is a Crown or State; and second of all, all those privileges, in ecclesiastical matters, granted by the Pope to the Spanish monarchs will be defined as regalities.
It should also be noted that this figure has always been very present in Spanish politics, since the State has always been interested in controlling the Church, both economically and spiritually. In addition, civil power and ecclesiastical power have always been closely linked, often intermingled, and from there arises the power of regalities.
With the intention of fulfilling the stated objective, this research has been developed in seven parts. It follows a very precise chronological order, which is as follows: it begins with the Ancient Age; it continues with the Middle Ages; the time of the Catholic Kings and the Habsburgs; the regalism in the New World; the Bourbon regalism; the Carlist and Spanish Elizabethan regalism of the nineteenth century; and finally the twentieth century until the death of Franco.
