La educación inclusiva de menores con discapacidad en el sistema español. ¿Derecho o Principio?
Abstract
Entre las numerosas discriminaciones que sufren los menores con discapacidad, se encuentra la separación en centros educativos ordinarios y especiales. En España se ha ido avanzando desde la ausencia absoluta de educación de los niños y niñas con discapacidad hasta su escolarización obligatoria, con la inclusión como objetivo. En este trabajo se analizará el estado de la legislación española en la cuestión y la divergencia con las obligaciones internacionales suscritas, con el objetivo de demostrar que en el sistema español la educación inclusiva se entiende como un principio y no como un derecho. Esto conlleva una negación sistemática a los menores con discapacidad de ser integrados con los demás niños. A menudo, las administraciones educativas justifican no adoptar ajustes en base a la falta de recursos económicos. Sin embargo, en cuestiones de discriminación, esta justificación no es válida y no debe impedir la inclusión de estos menores. Among the numerous discriminations that minors with disabilities suffer, there is the separation between ordinary and special educational centers. In Spain, the system has advanced from absolute absence of education of children with disability to their mandatory schooling, with inclusion as an objective. In this dissertation, the Spanish legislation and the divergence with international obligations subscribed by Spain will be analyzed, with the objective of proving that in the Spanish system, inclusive education is understood as a principle and not as a right. This leads to a systematic denial to integrate minors with disabilities with the rest of the children. The educational administration often justifies this on the basis of lack of economic resources to perform adjustments. Nevertheless, in matters of discrimination, this argumentation is not valid and should not prevent the inclusion of these minors.
