dc.description.abstract | El Impuesto sobre Sucesiones y Donaciones es actualmente un tema controvertido debido a que, al no ser un impuesto armonizado, cada Estado miembro tiene su propia regulación que puede ser o no contraria al Derecho de la Unión Europea. En este trabajo se analiza el hecho de que en España existe un doble problema; a nivel internacional, el ISD español discrimina a los no residentes extranjeros y crea problemas de doble imposición internacional. A nivel nacional, se podría plantear una presunta inconstitucionalidad del tributo por ser contrario a ciertos principios constitucionales como el principio de igualdad, de no confiscatoriedad, de capacidad económica y de no discriminación, al existir diferencias de trato entre residentes de las distintas Comunidades Autónomas. Se analiza también la perjudicial postura del Impuesto sobre Donaciones frente al de Sucesiones, ya que para el primero falta la previsión de reducciones además de que el donante tendría que pagar impuestos por las plusvalías generadas. Organismos como la Comisión Europea, la OCDE y el FMI han recomendado a España la no supresión del Impuesto por no poderse permitir el rechazo de la cantidad monetaria percibida en concepto de ISD debido al alto déficit y las deudas con Europa. dc.description.abstract | The Inheritance and Gifts Tax is currently a controversial issue because, as it is not a harmonized tax, each State member has its own regulation which may or might not be contrary to the Law of the European Union. This paper analyzes the fact that in Spain there is a double problem; at the international level, the Spanish ISD discriminates against foreign non-residents and creates problems of international double taxation. At the national level, there could be an alleged unconstitutionality of the tribute for being contrary to certain constitutional principles such as the principle of equality, non-confiscation, economic capacity and non-discrimination, as differences in treatment between residents exist of the different Autonomous Communities. It also analyzes the detrimental position of the Tax on Gifts against the Tax on Successions, since for the first, there is a lack of reductions in addition to the donor would have to pay taxes for the gains generated. Agencies such as the European Commission, the OECD and the IMF have recommended to Spain the non-abolition of the Tax because it could not allow the rejection of the perceived monetary amount of ISD due to the high deficit and debts with Europe. On the contrary, these Organisms if they estimate convenient a tribute reform. | en-GB |
