Análisis tributario de las criptomonedas
Abstract
Cuando la tecnología punta y las finanzas se asocian es difícil evitar la revolución global del mercado, pero sólo los más afortunados y audaces pueden beneficiarse realmente de estos cambios. Bueno... los más afortunados, y la Hacienda Pública. Este trabajo aborda los principales aspectos jurídico-tributarios, aportando una valoración crítica, que la normativa y doctrina administrativa otorgan a las monedas virtuales, una de las ramas del FinTech que más ha dado que hablar en los últimos tiempos. Para ello, se ha realizado un estudio de la trayectoria de la tecnología blockchain, sin descuidar su naturaleza jurídica, regulación, tendencias de futuro y potencial uso indebido (elusión, fraude fiscal y otros
delitos) de estos activos digitales. Linking cutting-edge technology and corporate finance generates for sure a market revolution; nevertheless, only the luckiest and boldest traders do really take advantage of these changes and make enormous profit from them. The luckiest traders and public finance systems, of course. This paper elaborates from a legal perspective the consideration addressed by tax authorities, involving critical appraisal, on the use of these virtual currencies, one of the most renowned examples of FinTech. In order to achieve this goal, it is convenient to analyze the financial history of blockchain technology, without ignoring its legal status, current legal framework, future trends and potential misuse (financial crime, money laundering and tax evasion) of these digital
assets.
