Justicia restaurativa en delitos de terrorismo

Abstract

En el presente trabajo se propone el estudio de una revisión bibliográfica sobre la Justicia Restaurativa en delitos de terrorismo, en este caso se explicará qué es la Justicia Restaurativa y se realiza una breve comparación con la Justicia Retributiva, además revisaremos los principales modelos de mediación, el lineal de Harvard, el modelo transformativo de Baruch y Folger y el Circular Narrativo de Sara Cobb, su posible aplicación en la mediacion penal, y sobre todo en la mediación penal en delitos de terrorismo. Se explicará como se realiza la mediación en estos delitos de forma más detallada, en que momento del proceso podemos realizarla, que características tiene que tener la víctima y el agresor, y las consecuencias que este proceso tendrá sobre la víctima y el victimario.

The present study aims to offer a revision of the literature on Restorative Justice in terrorism crimes. In this case, we will explain what Restorative Justice is, and we will provide a brief comparison with Redistributive Justice. Furthermore, we will revise the main models of mediation: the linear model by Harvard, the transformative model by Baruch and Folger, and the circular narrative model by Sara Cobb. In addition, we will assess its possible implementation in criminal mediation, and especially in criminal mediation for terrorist offences. We will further explain how mediation is conducted with this crimes, when it can be achieved, what are the main characteristics of the victim and the perpetrator, and the consequences this process will have on the victim and on the aggressor.
