El respeto a la diversidad cultural en la adopción internacional

Abstract

La adopción internacional es una de las medidas a las que tienen derecho aquellos menores a los que su familia biológica no puede mantener o proporcionar un entorno adecuado, por lo que las Autoridades Centrales de los Estados objeto de la adopción, tendrán que iniciar el proceso de dicha figura, atendiendo al derecho internacional y nacional relativo a la misma, garantizando en todo momento el interés superior del niño y el respeto a sus derechos fundamentales. Todo menor tiene reconocido el pleno derecho a crecer y desarrollarse armónicamente en un ambiente familiar, de amor y felicidad, de manera permanente. En derecho internacional, destacamos, por un lado, la Convención sobre los Derechos del Niño de 1989, de carácter obligatorio para los Estados firmantes, y, por otro lado, tenemos el Convenio de la Haya de 1993, en el cual se reconocen los principios de la Convención de 1989. Y en el ámbito nacional, es decir, en el territorio español, se atiende a la Ley de Adopción Internacional (Ley 54/2007, de 28 de diciembre, de Adopción internacional).

Intercountry adoption is one of the measures to which minors to whom their biological family cannot maintain or provide an adequate environment have the right. Therefore, the Central Authorities of the States that are the object of the adoption will have to initiate the process of this figure, in accordance with international and national law relating to it, guaranteeing at all times the best interests of the child and respect for his or her fundamental rights. Every child has the full right to grow and develop harmoniously in a family environment of love and happiness on a permanent basis. In international law, we highlight, on the one hand, the 1989 Convention on the Rights of the Child, which is binding on the signatory States, and, on the other hand, the 1993 Hague Convention, which recognizes the principles of the 1989 Convention. And at the national level, that is to say, in Spanish territory, the Law on International Adoption (Law 54/2007, of 28 December, on International Adoption) is observed.
