Abstract

El matrimonio, tradicionalmente, era la unión legal de un hombre y una mujer dirigida a establecer una comunidad de vida; a fundar una familia. Con el paso de los años, varias reformas legales (en especial la Ley 13/2005, de 1 de julio por la que se modifica el Código civil en materia de derecho a contraer matrimonio y la Ley 15/2005, de 8 de julio, por la que se modifican el Código civil y la Ley de Enjuiciamiento civil en materia de separación y divorcio). Ellas han afectado a esta institución para adaptarla a la sociedad actual. Por este motivo es necesario conocer qué requisitos necesita reunir una persona y qué trámites debe seguir tanto de fondo (edad núbil; inexistencia de vínculo matrimonial subsistente; capacidad de obrar; no estar incursos en algún impedimento matrimonial, prestación del consentimiento; etc.) como de forma (expediente matrimonial; testigos, autoridad competente para la celebración; inscripción en el Registro civil, etc.) para poder contraer matrimonio válidamente de acuerdo con nuestra legislación.
