Un año electoral crucial para Europa: normativa y jurisprudencia

Abstract

Este artículo analiza los principales desarrollos políticos, normativos y de jurisprudencia de la UE en materia de migración y asilo que han tenido lugar en 2016 y la primera mitad de 2017. Durante ese periodo los avances normativos en estas materias entran en una fase de inercial. Las limitadas reformas que se llevan a cabo se centran esencialmente en adaptar el sistema de asilo (Dublín IV) y en consolidar y dotar de mayor eficacia a los instrumentos de gestión migratoria y de control de fronteras, así como de retorno de extranjeros. Al mismo tiempo que se convocaban elecciones clave en diversos países y el fantasma del populismo acechaba en muchas de ellas, la entrada de refugiados se iba reduciendo tras dos años muy intensos en este sentido.

During the period covered by this annual (January 2016 to June 2017), regulatory advances in terms of immigration and asylum entered a phase of inertia with highly imited reforms in the European Union setting, which essentially focussed on adapting the asylum system (Dublin IV) and on consolidating and giving greater effectiveness to migration management and border control instruments, as well as the return of non-nationals. At a time when key elections were called in various countries and were stalked by the ghosts of populism, the entry of refugees steadily fell after two very intense years.
