Tipos penales en el deporte

Abstract

El objetivo de este trabajo es realizar una síntesis de las diferentes normas que regulan los delitos que pueden cometer los agentes que integran el mundo del deporte, desde las instituciones hasta los propios deportistas, incluyendo un análisis de los casos que han tenido más importancia a nivel doctrinal y a nivel mediático, tratando de definir la situación y el contexto actual en torno a estos delitos. Las conductas que más repercusión pueden generar y, por tanto, a las que se dedica más atención son la corrupción en el ámbito deportivo y el dopaje. Tras exponer la regulación y los diferentes organismos que persiguen estas infracciones, se aborda la jurisprudencia considerada más relevante. Los casos a los que se hace referencia en lo que respecta a la corrupción deportiva son el Caso Levante-Zaragoza, el Caso Osasuna y el Caso Oikos, mientras que los asuntos relacionados con el dopaje que se desarrollan son la Operación Puerto y el Caso Gurpegui. En cuanto al panorama internacional, se describen las normas e instituciones que afectan a estos delitos, para posteriormente mencionar un caso de corrupción y otro de dopaje. Este documento está principalmente centrado en el fútbol, el deporte más seguido del mundo y en el que es muy frecuente encontrar casos de amaños de encuentros deportivos. También se presta especial atención al ciclismo y al atletismo, dos de las disciplinas más relevantes en lo que respecta al consumo de sustancias prohibidas en el deporte.

The aim of this work is to carry out a synthesis of the different rules that regulate the crimes that the agents that make up the world of sport may commit, from institutions to athletes, including an analysis of the cases that have had more importance at the doctrinal and mediatic level, trying to define the current situation and context around these crimes. The behaviors that can generate the most repercussion and, therefore, the ones that are given the most attention are corruption in sports and doping. After exposing the regulation and the different organisms that pursue these infractions, the most relevant jurisprudence is exposed. The cases referred to regarding sports corruption are the Levante-Zaragoza Case, the Osasuna Case and the Oikos Case, while the doping-related issues that are developed are the Puerto Operation and the Gurpegui Case. Regarding the international scene, the norms and institutions that affect these crimes are described, to later mention a case of corruption and another one of doping. This document is mainly focused on soccer, the most followed sport in the world and in which match fixing cases are very common. Special attention is also paid to cycling and athletics, two of the most relevant disciplines when it comes to the consumption of prohibited substances in competitions.
