Propuesta de un sistema electoral alternativo del Congreso de los Diputados
Abstract
El sistema electoral es uno de los pilares fundamentales de la democracia. En España, son frecuentes las críticas a un sistema electoral que lleva sin reformarse desde 1977. El sistema electoral no ha evolucionado conforme lo ha hecho el contexto social y político y, consecuentemente, los objetivos que persigue no se adecúan al contexto nacional actual.
El objeto del presente trabajo es proponer una reforma electoral que ayude a mitigar algunos de los defectos de los que adolece el sistema electoral español para que se adecúe a las necesidades sociales actuales. Entre estos defectos destacan las desigualdades en la distribución y atribución de escaños, la falta de participación ciudadana en la decisión electoral y la falta de eficacia del sistema. Como consecuencia, se corre el peligro de que se considere que el sistema electoral español carezca de legitimidad.
Si bien es cierto que no existe el sistema electoral ideal, creemos que mediante una reforma constitucional y orgánica de la normativa electoral que suponga la sustitución de la circunscripción provincial por una única circunscripción nacional y el establecimiento de una barrera electoral elevada de alcance nacional produciría una mejora considerable de los defectos citados y, como resultado, a una considerable mejora del sistema electoral español. The electoral system is one of the main pillars of democracy. In Spain, there are frequent criticisms of an electoral system that has not been amended since 1977. The electoral system has not evolved as the social and political context has, and as a consequence, the aims it pursues are not suitable to the current national context.
The aim of the present paper is to propose an electoral reform that would help to mitigate some of the deficiencies of the Spanish electoral system in order to meet current social needs. Among these weaknesses are the inequalities in the distribution and attribution of mandates, the lack of citizen participation in the electoral decision and the lack of efficiency of the system. As a result, there is a danger of being considered that the Spanish electoral system lacks legitimacy.
Although it is true that the ideal electoral system does not exist, we believe that by means of a constitutional and organic reform of the electoral regulation, involving the replacement of the provincial constituency by a single national constituency and the establishment of a high electoral barrier of national scope, would produce a considerable improvement of the above-mentioned defects and, as a result, a considerable improvement of the Spanish electoral system.
