Consecuencias jurídicas del 'Brexit'

Abstract

El Brexit ha sido uno de los mayores hitos de la historia moderna, sin embargo, existe todavía una gran incertidumbre sobre sus consecuencias y el futuro del orden mundial. Si bien es cierto que el proceso de salida del país de la Unión Europea afectará a diversos sectores, el sector jurídico será uno de los más perjudicados ya que deberá soportar las consecuencias negativas que conlleva. Se analizan pues, en el siguiente trabajo, los antecedentes y el procedimiento de salida del Reino Unido desde una perspectiva jurídica, a través del estudio exhaustivo del artículo 50, donde se recoge el derecho de retirada y sus requisitos. Por otro lado, se exponen los posibles efectos jurídicos que presenta el Brexit focalizando el análisis en cinco esferas principalmente (comercio, fiscalidad, derecho laboral, ámbito empresarial y derechos de los ciudadanos). Además, se estudia la situación tanto de los ciudadanos británicos en la Unión Europea como la de los ciudadanos de la Unión Europea en el Reino Unido.

Brexit has been one of the greatest landmarks in modern history, yet there is still great uncertainty about its consequences and the future of the world order. While it is true that the process of the country's exit from the European Union will affect various sectors, the legal sector will be one of the most affected, as it will have to bear the negative consequences that it entails. The following paper therefore analyses the background and the exit procedure of the United Kingdom from a legal perspective, through a comprehensive study of Article 50, which sets out the right of withdrawal and its requirements. On the other hand, the possible legal effects presented by the Brexit are set out, focusing the analysis on five main areas (trade, taxation, labour law, corporate sector and citizens' rights). In addition, the situation of both British citizens in the European Union and European Union citizens in the United Kingdom is studied.
