dc.description.abstract | En el presente trabajo se lleva a cabo el análisis de la longeva institución de la empresa familiar y la definición su concepto, dada su gran relevancia en el panorama socio-económico actual. Para ello, recurriremos a la normativa al respecto (a pesar de ser parca y fragmentaria), jurisprudencia y doctrina. A lo largo del estudio, tendremos oportunidad de detenernos en la explicación de los ciclos vitales de estas compañías, a fin de comprender a qué se debe el alto índice de mortalidad que amenaza con destruir su sueño: la continuidad de una a otra generación, con el propósito de crear una auténtica dinastía. Esto nos llevará a diagnosticar las causas del problema en la fase crucial: la sucesión, momento en el cual el fundador cede el negocio a sus predecesores. En aras de favorecer la perdurabilidad, se propondrá recurrir a métodos que anticipen los conflictos y que establezcan reglas para solventarlos en caso de que tengan lugar. Finalmente, expondremos la que es, a nuestro juicio, la mejor solución: crear un Protocolo Familiar que regule las relaciones de índole empresarial y familiar que se dan en este ámbito tan complejo, en el cual será difícil diferenciar los sentimientos encontrados que produce la obligación de actuar como jefe y como padre al mismo tiempo. | es-ES |
dc.description.abstract | In this final degree project, the analysis of the long-standing family business institution and the definition of its concept are carried out, given its great relevance in the current socio-economic panorama. For this, we will resort to the regulations in this regard (despite being sparing and fragmentary), jurisprudence and doctrine. Throughout the study, we will have the opportunity to pause to explain the life cycles of these companies, in order to understand why the high mortality rate that threatens to destroy their sleep is due: the continuity of one generation to another, with the purpose of creating an authentic dynasty. This will lead us to diagnose the causes of the problem in the crucial phase: succession, at which point the founder cedes the business to his predecessors. In order to promote durability, it will be proposed to resort to methods that anticipate conflicts and establish rules to resolve them in the event that they occur. Finally, we will present what is, in our opinion, the best solution: create a Family Protocol that regulates the relationships of a business and family nature that occur in this complex area, in which it will be difficult to differentiate the mixed feelings that the obligation produces to act as a boss and as a father at the same time. | en-GB |
