El papel del poder judicial en el Estado constitucional español: ¿Creador de Derecho o mero aplicador?

Abstract

Este trabajo pretende analizar el papel del Poder Judicial, en especial a través del Tribunal Supremo, en el ordenamiento jurídico español. A través del estudio de dos casos concretos, se pretende discutir sobre su papel como creador de derecho, o como mero aplicador.

In this paper we seek to study the role of the judiciary in Spain, specially the impact of the Spanish Supreme Court. By studying several cases, we try to determine if the court indeed creates new law, or if instead it merely applies the existing legal dispositions.
