La prevalencia del derecho a la vida sobre el derecho a morir. Análisis comparado de la jurisprudencia constitucional en España y otros países de la Unión Europea

Abstract

El presente trabajo pretende llevar a cabo un análisis del contenido negativo del derecho a la vida y su tratamiento en España, Holanda, Irlanda y el Tribunal Europeo de Derechos Humanos. Tras exponer la regulación penal del suicidio asistido y la eutanasia activa directa en las cuatro jurisdicciones objeto de estudio, se examina el razonamiento de cada Tribunal en su tratamiento del derecho a morir. El objeto último es determinar si existe en Europa una inclinación por reconocer la existencia del derecho a disponer de la propia vida, en relación con los valores superiores de la libertad y la dignidad.

This paper aims to carry out an analysis of the negative content of the right to life and its treatment in Spain, the Netherlands, Ireland and the European Court of Human Rights. After exposing the criminal regulation of assisted suicide and active euthanasia in the four jurisdictions under study, the reasoning of each Court in its treatment of the right to die is examined. The ultimate aim is to determine whether there is an inclination in Europe to recognize the existence of the right to end one’s life, in relation to the higher values of freedom and dignity.
