dc.description.abstract | El siguiente trabajo fue motivado por el potencial, el valor y la importancia creciente del Third-Party Funding en el arbitraje tanto internacional como nacional. El objetivo de este trabajo es la elaboración de un primer estudio sobre el Third-Party Funding en España de forma extensa. La novedad de esta figura provoca una ausencia normativa y casi doctrinal al respecto. Acudiendo a manuales internacionales, doctrina de escasa extensión y diferentes estudios, se presenta el primer trabajo en España acerca de la situación del sistema de financiación por terceros en el arbitraje a nivel nacional, pasando por la situación del mismo a nivel internacional, y acabando con la propuesta de un sistema de autorregulación para solventar el problema de ausencia normativa. Desde un punto de general hasta otro más específico: desde la contextualización del arbitraje hasta la situación del litigation funding en el arbitraje español. El trabajo visualiza los distintos tratos legales y prácticos a nivel internacional, discutiendo y evaluando estas posibilidades se llega a una conclusión de que la mejor alternativa normativa es un sistema de autorregulación. | es-ES |
dc.description.abstract | This paper regards the potential value and increasing importance of Third-Party Funding in international arbitration, as well as in the Spanish arbitration system. The main objective of this article is to redact the first extensive study on the situation of third party funding in Spanish arbitration. We resolved the absence of extended articles or legislation in Spain by accessing international papers, some national articles, and different studies. The article goes from a broader point of view –from the contextualization of the arbitration proceeding– to a more specific one -the situation of the TPF in Spain. Furthermore, through the study and evaluation of other legislative treatments of the litigation funding proceedings, we conclude that the best alternative to the absence of regulation in Spain is a Self-regulation system. | en-GB |
