La capacidad del menor en el ámbito sanitario

Abstract

El trabajo analiza los cambios legislativos de la Ley de Autonomía del paciente y del Código civil del año 2015 en concreto por la LO 8/2015 y la Ley 26/2015 relativos a la autonomía de la voluntad de los menores maduros en relación con su salud, particularmente las causas y los efectos de dichos cambios. Para ello se llevará a cabo un análisis de la capacidad del menor en general, en los derechos de la personalidad y finalmente en el ámbito de la salud. Destacando la importancia de escuchar al menor, así como de actuar de acuerdo con su interés superior. Por medio de ejemplos sobre la autonomía del menor en el ámbito sanitario como son: el consentimiento informado y el consentimiento por representación, el rechazo al tratamiento del menor maduro, el ámbito de la salud sexual y reproductiva y los menores con disforia de género, se analizará la línea aperturista de la jurisprudencia y el impacto que han tenido las reformas, así como las diversas opiniones doctrinales.

The paper analyzes the legislative changes of the Patient Autonomy Law and the Civil Code of the year 2015 in particular by LO 8/2015, Law 26/2015 or LO 11/2015. Concerning the autonomy of the will of mature minors in relation to their health, particularly the causes and effects of such changes. This will be done through an analysis of the capacity of the minor in general, in the rights of the personality and finally in the field of health. Emphasizing the importance of listening to the minor, as well as acting in his or her best interests. Using examples: on the autonomy of the minor in the health field such as: informed consent and consent by proxy, refusal to treat the mature minor, the field of sexual and reproductive health and children with gender dysphoria, will be analyzed the opening line of the jurisprudence and the impact that the reforms have had, as well as the diverse doctrinal opinions.
