"La capacidad jurídica en la antigua Roma"

Abstract

Actualmente, todas las personas, por el mero hecho de serlo, son consideradas como sujetos jurídicos aptos para ostentar derechos y obligaciones. No obstante, si analizamos el recorrido histórico de las diferentes legislaciones, podemos apreciar cómo esto no fue siempre así. El presente trabajo de investigación analiza los distintos grados de capacidad jurídica, en función de los tres status (libertatis, civitatis, y familiae), de los que gozaban los diversos sujetos de la antigua Roma frente a su ordenamiento jurídico.

Nowadays, every person, by the mere fact of being one, is considered as a legal subject capable of having rights and obligations. However, if we analyse the historical path of the different legislations, we can appreciate how this was not always the case. The following case study analyses the different degrees of legal capacity, according to the three status (libertatis, civitatis, and familiae), enjoyed by the diverse subjects of the ancient Rome with regard to its legal system.
