dc.description.abstract | El presente trabajo trata sobre la posición que ocupan los falsos autónomos actualmente en nuestro ordenamiento, especialmente los que han surgido como consecuencia de la economía colaborativa. Es un tema de especial importancia y que requiere de estudio, ya que los trabajadores contratados falsamente como autónomos resultan desprotegidos y perjudicados al sufrir una disminución de sus derechos laborales y de Seguridad Social. Estudiaremos la figura de falso autónomo, las formas en las que aparecen en nuestro ordenamiento y las consecuencias de su existencia. Los tribunales se han tenido que enfrentar recientemente a numerosas demandas de trabajadores contratados como autónomos y que reclaman su consideración como trabajadores laborales. La tarea a la que se enfrentan los tribunales es de gran complejidad por el carácter indiciario de la laboralidad y por la diversidad de opiniones doctrinales. | es-ES |
dc.description.abstract | The aim of this paper is dealing with the position of false self-employed currently in our system, especially those that have emerged as a result of the collaborative economy. It is a topic of special importance and that requires study, since workers falsely hired as self-employed are unprotected and harmed by suffering a decrease in their labor and Social Security rights. We will study the figure of the false self-employed, the forms in which they appear in our system and the consequences of their existence. The courts have recently had to deal with numerous lawsuits from workers hired as self-employed and who claim to be considered as working workers. The task facing the courts is highly complex due to the indicative nature of labor law and the diversity of doctrinal opinions. | en-GB |
