Estudio de la Ley relativa al consentimiento paterno para contraer matrimonio de 20 de junio de 1862

Abstract

Tras el fallido intento de unificar la legislación en el territorio español mediante el Proyecto del Código Civil de 1852, se trata de hacer esta unificación mediante leyes especiales. Una de estas leyes es la Ley del Disenso Paterno de 1862. Esta norma será el objeto de estudio de este trabajo. La finalidad de esta ley, es la de regular la necesidad de los hijos de contar con el consentimiento paterno a la hora de contraer matrimonio, de manera que se refuerce así la autoridad paterna en el ámbito familiar. De esta manera, nos adentraremos no solo en el proceso de tramitación de la ley y su articulado, sino que también obtendremos una visión sobre la importancia de la figura paterna en la familia durante la segunda mitad del siglo XIX.

After the failed attempt to unify the Spanish legislation by the implantation of a civil code, this unification is again tried by special laws. One of this is the Parent Consent Law of 1862. This rule is the object of this assignment. The purpose of this law is to regulate the children’s necessity to have their parents consent in order to marry, that way parent’s authority is reinforced. To study this law, we will not only get into the making process and articles of the law, but also, we will get a vision about the importance of the father figure during the second half of the 19th Century.
