Presente y futuro del trabajo autónomo: el trabajo autónomo como alternativa para reducir el desempleo juvenil

Abstract

El presente estudio pretende poner en valor la opción del trabajo por cuenta propia como alternativa para reducir los altos niveles de desempleo juvenil en España. Para ello se realiza, en una primera instancia, una categorización del trabajo autónomo, prestando especial atención a la jurisprudencia, para seguidamente proceder a un análisis de las distintas normas adoptadas y que ordenan las relaciones de este colectivo. Se pone especial énfasis en el examen de las medidas adoptadas en materia de Seguridad Social, debido al gran potencial que estas tienen para impulsar este tipo de actividad, pues estas pretenden hacer el inicio de una actividad por cuenta propia menos onerosa. Tanto la reducción de cuotas como la mayor cobertura social que las sucesivas reformas han ido ofreciendo hacen menos arriesgado el emprendimiento. Para finalizar, se ofrecen unas reflexiones acerca de cómo el autoempleo podría reducir los elevados índices de desempleo juvenil en España. No obstante, debido a la escasa tradición emprendedora existente en España, la actividad por cuenta propia deberá ser fomentada en todos los niveles educativos, enfatizando el valor que esta tiene en nuestra economía y para la sociedad. Los poderes públicos y el legislador, conscientes de ello, han adoptado medidas orientadas a promover el trabajo autónomo.

The present study aims to highlight the option of self-employment as an alternative to reduce the high levels of youth unemployment in Spain. To this end, a categorisation of self-employment is first made, paying special attention to case law, and then an analysis is made of the different rules adopted and which order the relations of this group. Special emphasis is placed on the examination of the measures adopted in the area of Social Security, due to the great potential that these have for promoting this type of activity, since they aim to make the start of self-employed activity less onerous. Both the reduction of contributions and the greater social coverage that successive reforms have offered make entrepreneurship less risky. Finally, we offer some reflections on how self-employment could reduce the high rates of youth unemployment in Spain. However, due to the limited tradition of entrepreneurship in Spain, self-employment should be encouraged at all levels of education, emphasising its value to our economy and society. The public authorities and the legislator, aware of this, have adopted measures aimed at promoting self-employment.
