Puros e impuros: la prevalencia de la casta en el imaginario social de la India
Abstract
Los Derechos Humanos incluyen dentro de sus rasgos principales su carácter universal. Esta característica implica que los Derechos Humanos son aplicables en todas partes del mundo la misma forma. Frente a esta concepción, el relativismo cultural afirma que los Derechos Humanos no deben aplicarse de igual manera en todas las partes del mundo, sino que esta aplicación debe ser en base y de acuerdo con las diferentes culturas. Así surge una lucha doctrinal entre estas dos posturas, en la que el universalismo se superpone al relativismo.
Sin embargo, y a pesar de las medidas y recomendaciones llevadas a cabo por el Derecho Internacional de los Derechos Humanos, y traspasadas al marco nacional, en la India el sistema de castas, un sistema milenario que estratifica a los individuos en base a su pureza, prevalece. Esta prevalencia del sistema ha impedido la efectiva implantación y por lo tanto ejercicio de los Derechos Humanos de los individuos pertenecientes a las castas más bajas, que son constantemente sometidos a un trato discriminatorio por su impureza. In contrast to this conception, cultural relativism affirms that Human Rights should not be applied in the same way in all parts of the world, but that this application should be based on and in accordance with the different cultures. Thus, a doctrinal conflict arises between these two positions, in which universalism is superimposed on relativism.
However, despite the measures and recommendations carried out by the International Human Rights Law, and transferred to the national framework, in India the caste system, a millenary system that stratifies individuals on the basis of their purity, prevails. This prevalence of the system has prevented the effective implementation and hence exercise of human rights by individuals belonging to the lower castes, who are constantly subjected to discriminatory treatment on account of their impurity.
