Unaccompanied Migrant Minors at the Frontier of Human Rights. The Spanish Case

Proteger a los niños es fundamental para defender los valores europeos de respeto por los derechos humanos, la dignidad y la solidaridad. También se trata de hacer cumplir la ley de la Unión Europea y respetar la Carta de los Derechos Fundamentales de la Unión Europea y el derecho internacional de los derechos humanos sobre los derechos del niño. La legislación vigente de la UE proporciona un marco para la protección de los derechos del niño en la migración, incluidas las condiciones de recepción, el tratamiento de sus aplicaciones e integración. Este artículo desarrolla las disposiciones relativas al sistema de protección internacional para menores migrantes. Examina las estrategias de entrada implementadas por los jóvenes migrantes que enfrentan el sistema migratorio español. La primera parte examina las pautas del sistema de recepción para menores migrantes no acompañados que llegan a España. En la segunda parte, se realiza una evaluación de los arreglos españoles para la recepción de los MENAs, centrándose en tres aspectos clave: devolución en la frontera (retroceso), determinación de la edad y tutela.

Protecting children is paramount for upholding the European values of respect for human rights, dignity and solidarity. It is also about enforcing European Union law and respecting the Charter of Fundamental Rights of the European Union and international human rights law on the rights of the child. The existing EU legislation provides a framework for the protection of the rights of the child in migration, including reception conditions, dealing with their applications and integration. This article elaborates on provisions concerning the international protection system for minor migrants. It examines entry strategies put into place by young migrants facing the Spanish migration system. The first part examines the guidelines of the reception system for unaccompanied migrant minors arriving in Spain. An assessment of the Spanish arrangements for the reception of umms is carried out in the second part, focussing on three key aspects: refoulement at the border (pushback), age determination and guardianship.
