Una de las cuestiones más discutidas de la Parte General del Derecho Penal es determinar la relevancia de la conducta de la víctima para modificar la responsabilidad penal del autor. En este artículo se presenta y critica la solución propia del profesor Gimbernat, que él ubica en la categoría de la imputación objetiva del resultado. Dentro de ella es relevante el criterio del consentimiento de la víctima, que permite hablar de autopuestas en peligro impunes, por oposición a heteropuestas en peligro punibles. One of the most discussed topics of the Criminal Law theory is to determine the relevance of the behavior of the victim to modify the criminal responsibility of the criminal author. This article presents and criticizes the original solution of the teacher Gimbernat, which he locates in the category of the objective imputation of the harm. Within it is the relevant criterion of the victim's consent, which allows you to talk about unpunishable self-endangering,as opposed to punishable hetero-endangering.
