Justicia restaurativa y cuestiones de política criminal

Abstract

Resumen Los abusos sexuales a menores constituyen un problema histórico y universal que tiñe parte de la realidad de la Iglesia Católica. Sin embargo, pese a la magnitud de su importancia, son muy pocas las instituciones que, internacionalmente, se han decidido a estudiar este asunto, tanto en cifras como en impacto. Este trabajo ha pretendido, primero, realizar un estudio sistemático de las fuentes oficiales que hasta ahora se conocen; y segundo, analizar el tratamiento que de esta realidad se ha venido proponiendo desde entonces. Los resultados aflorados por el estudio permitieron comprender la homogeneidad interterritorial de la masividad de casos detectados. Además, se consiguió determinar el paradigma restaurativo como el más efectivo en el tratamiento del impacto de este tipo de victimizaciones. Finalmente se concluye que este trabajo aporta ganancias significativas, al compilar dichos estudios y al establecer un modelo de Justicia Restaurativa que aúna dos de los ya establecidos para tratar esta realidad victimal diferenciada.

Abstract Child sexual abuse constitutes both a universal and historical problem that tinges part of the Catholic Church reality. However, despite its relevance, there are not many institutions that, in an international frame, have promoted studies related to this purpose, neither quantitative nor qualitative. Hence, the aim of this work was to conduct a systematic study which explores the official data available today and to analyse which could be the treatment response to the problem from then on. The results shown by this study enlightened the interterritorial homogeneity of a massive number of cases detected. Besides, this work has determined the restorative paradigm to be the most effective for the treatment of these sort of victimizations. In conclusion, this manuscript provides meaningful outcomes, as it first gathers all those mentioned studies and second, introduces a model of Restorative Justice that combines two other stablished to treat this differentiated victimological context.
