Abstract

Tras la ruptura del matrimonio, mediante la separación o el divorcio, siempre que hay hijos es necesaria la redacción de un acuerdo legal denominado convenio regulador en el que conste, entre otras cosas, la relación entre los progenitores con sus hijos a nivel de patria potestad, guarda y custodia. El informe psicológico pericial, actualmente valorado positivamente por parte de los jueces, supone una herramienta de auxilio al juez en la toma de decisiones con respecto a esas relaciones paternofiliales considerando la competencia parental de cada progenitor y siempre en beneficio del interés superior del menor. Para la realización del mismo, se lleva a cabo una entrevista semiestructurada a uno o ambos progenitores en busca de una serie de criterios considerados esenciales para determinar la capacidad parental recogidos tras el análisis de sentencias y resoluciones judiciales y, aunque se cuentan con pocas herramientas psicométricas adaptadas al contexto forense, destaca el Cuestionario para la Evaluación de Adoptantes, Cuidadores, Tutores y Mediadores (CUIDA, Bermejo et al., 2006) como prueba objetiva de valoración de aquellas variables de personalidad que aportan información sobre el establecimiento competente y funcional de las relaciones de cuidado. Actualmente, el 65% de los informes son realizados por el equipo psicosocial adscrito al juzgado frente al psicólogo privado, en el 57,17% de las valoraciones de patria potestad se tiene en cuenta la ausencia o presencia de enfermedad mental y en el 42,22% de las valoraciones de guarda y custodia se tiene en cuenta la idoneidad para el ejercicio de la parentalidad.

After marital breakdown, through separation or divorce, whenever there are children, it is necessary to draw up a legal agreement called regulating agreement, that establishes, among other things, the relationship between the parents and their children in terms of parental authority, care and custody. The expert psychological report, currently valued positively by the judges, is a tool to help the judge in making decisions regarding these parent-child relationships, considering the parenting skills of each parent and always in the best interest of the child. To prepare the report, a semi-structured interview is carried out with one or both parents in search of a series of criteria considered essential to determine parental capacity gathered after the analysis of court´s judgment and court decisions and, although there are few psychometric tools adapted to the forensic context, highlights the Questionnaire for the Evaluation of Adoptors, Caregivers, Tutors and Mediators (CUIDA test, Bermejo et al., 2006) as an objective assessment test of those personality variables that provide information on the competent and functional establishment of the caring relationships. Currently, 65% of the reports are made by the psychosocial team assigned to the court instead of the private psychologist, in 57.17% of the evaluations of parental authority the absence or presence of mental illness is taken into account and in 42, 22% of the care and custody evaluations take into account the suitability for the exercise of parenting.
