UNA MIRADA CRÍTICA DE LOS DERECHOS SOCIALES

Abstract

Este trabajo estudia el concepto de los derechos sociales, así como su regulación en la Constitución Española y cuestiona su efectividad jurídica. Además, se explora la relación entre la economía de mercado y los derechos sociales estudiando la relación de tensión entre el liberalismo económico y la necesaria intervención del Estado para cumplir con los derechos sociales. Al final del mismo, se abordan los derechos sociales de la educación y la sanidad, así como las garantías que presenta nuestro sistema jurídico para su regulación y una crítica o debate referente a las limitaciones que han sufrido nuestros derechos en la presente crisis sanitaria.

This work studies the concept of social rights, as well as their regulation in the Spanish Constitution and questions their legal effectiveness. In addition, the relationship between the market economy and social rights is explored by studying the relationship of tension between economic liberalism and the necessary state intervention to fulfill social rights. At the end of it, the social rights of education and health are addressed, as well as the guarantees presented by our legal system for their regulation and a criticism or debate regarding the limitations that our rights have suffered in the present health crisis.
