Fundamentos y límites de la libertad de expresión y su relación con otros bienes y derechos constitucionales

Abstract

En este trabajo se analiza la regulación constitucional de la libertad de expresión y la jurisprudencia y doctrina sobre sus limitaciones, centrando el enfoque en los límites relativos a la tutela de otros bienes constitucionalmente protegidos como las instituciones del Estado democrático y los símbolos nacionales. Dentro de las instituciones del Estado democrático se pretenden explicar los límites de la libertad de expresión en los supuestos en los que se realizan ataques a figuras como la Corona, el Poder Ejecutivo, el Judicial, y las corporaciones locales. Se pretende dar una explicación a la pregunta de por qué estos bienes deben o no ser protegidos mediante delitos de carácter específico, y si protección es mayor o debe serla que para otros sujetos pasivos objeto de delito. Se realiza un análisis conceptual de la libertad de expresión en la Constitución Española así como en otros marcos reguladores internacionales. Se analiza la jurisprudencia del Tribunal Europeo de Derechos Humanos, del Tribunal Constitucional y de la Sala 2ª del Tribunal Supremo sobre el límite de la libertad de expresión. Asimismo, se analizan las normas y tratados al respecto, fuentes doctrinales sobre el asunto, así como la principal jurisprudencia de la Corte Suprema de Estados Unidos y cómo ésta ha influido al marco jurídico europeo.

This paper analyzes the constitutional regulation of freedom of expression and the jurisprudence and doctrine on its limitations, focusing on the limits relating to the protection of other constitutionally protected assets such as the institutions of the democratic State and national symbols. Within the institutions of the democratic State, reference is made to the limits of freedom of expression in cases in which attacks are made on figures such as the Crown, the Executive, the Judiciary, and local branches of government. The aim is to provide an explanation as to why these assets should or should not be protected by specific offenses, and whether protection is greater or should be greater than that of other passive subjects to crime. A conceptual analysis of freedom of expression in the Spanish Constitution as well as in other international regulatory frameworks is carried out. The jurisprudence of the European Court of Human Rights, the Spanish Constitutional Court and the 2nd Chamber of the Spanish Supreme Court on the limits of freedom of expression is analyzed. It also analyzes the relevant norms and treaties, doctrinal sources on the subject, as well as the main jurisprudence of the Supreme Court of the United States and how this has influenced the European legal framework.
