El trabajo a distancia: dimensión internacional del teletrabajo

Abstract

Como consecuencia de la crisis provocada por Covid-19, la modalidad de trabajo a distancia ha experimentado un crecimiento exponencial en España. A raíz de lo cual, el 22 de septiembre de 2020 se publicó el Real Decreto-Ley 28/2020, que regula el trabajo a distancia en España. Este hecho puede considerarse una ventaja creada por la gran crisis, tras la limitada y obsoleta normativa existente hasta la fecha sobre una de las herramientas capaces de atender a la nueva realidad social y profesional. El objetivo de este trabajo de investigación es tratar de analizar la regulación actual del trabajo a distancia, con el fin de incidir en el desafío que sigue generando la figura del teletrabajo transnacional.

As a consequence of the crisis triggered by Covid-19, remote working has experienced exponential development in Spain. As a result of which, on September 22nd, 2020, Real Decreto-Ley 28/2020 was published, regulating remote working in Spain. This fact can be considered an advantage created by the major crisis, given the limited and obsolete regulations that existed to date concerning one of the tools capable of addressing the new social and professional reality. The aim of this research paper is to attempt to analyse the current legislation on remote working, with the objective of focusing on the challenge that the figure of transnational remote working continues to generate.
