La nueva regulación del trabajo a distancia

Abstract

El trabajo a distancia está ganando cada vez más importancia como modalidad de trabajo. Por ello, es imprescindible que se le dote de una adecuada regulación en aras de garantizar y proteger tanto los derechos como las obligaciones de ambas partes, trabajador y empleador. En este Trabajo de Fin de Grado se realizará, desde un punto de vista práctico, un análisis valorativo del Real Decreto-ley 28/2020, de 22 de septiembre, de trabajo a distancia. Se incidirá en los efectos de la norma objeto de estudio determinando si el Real Decreto consigue la eficacia normativa que se le presume.

Distance work is gaining increasing importance as a working modality. It is therefore essential that it is adequately regulated in order to guarantee and protect the rights and obligations of both parties, worker and employer. This Final Degree Project will carry out, from a practical point of view, an evaluative analysis of Royal Decree-Law 28/2020, of 22 September, on remote work. It will focus on the effects of the regulation under study, determining whether the Royal Decree achieves the regulatory effectiveness it is presumed to have.
