Regulación de los criptoactivos

Abstract

El presente trabajo tiene como objetivo exponer y analizar la regulación aplicable a los criptoactivos. Al inicio del trabajo se presentan una serie de conceptos básicos en relación con los criptoactivos de cara a entender mejor su funcionamiento y particularidades. Posteriormente, se analizan, por un lado las propuestas en materia normativa de la Unión Europea y por otro lado, se valora la aplicabilidad de los reglamentos y directivas actualmente en vigor. Todo ello, con el objetivo de señalar posibles problemas y concluir proponiendo algunas mejoras.

The aim of this paper is to explain and analyse the regulation applicable to cryptoassets. At the beginning of the paper, a series of basic concepts related to cryptoassets are presented in order to better understand how they work and their particularities. It then goes on to analyse, on one hand, the European Union's regulatory proposals and, on the other, the applicability of the regulations and directives currently in force. The aim is to point out possible problems and to conclude by proposing some improvements.
