La nueva realidad: hacia la mercantilización del fútbol profesional.

Abstract

Este trabajo de investigación aborda la progresiva mercantilización del fútbol profesional en España y sus implicaciones jurídicas. En concreto, se centra en la entrada de inversores privados en este sector mediante las llamadas operaciones de “Third Party Ownership”. En relación con estas últimas, se estudian sus características principales, entre ellas, su uso como fuente de financiación alternativa, su formalización y su regulación actual a nivel mundial, europeo y nacional. Para ello, se analizan el Reglamento sobre el Estatuto y la Transferencia de Jugadores y las prohibiciones contenidas en sus arts. 18 bis y ter. Finalmente, este trabajo plantea una alternativa a la prohibición de TPOs consistente en su permisibilidad, proponiendo, para ello, una regulación de lege feranda.

This research paper addresses the progressive commodification of professional football in Spain and its legal implications. Specifically, this paper focuses on private investors’ entry into this sector through Third Party Ownership operations. With regards to these operations, this paper studies its main characteristics including their use as an alternative source of financing, their formalization as well as their regulation at the international, the European and the national level. To this effect, this paper analyses the Regulations on the Status and Transfers of Players and the restrictions contained in articles 18 bis and ter. Finally, this paper poses an alternative to the restrictions on TPOs by arguing in favor of their permissibility through the proposal of a lege feranda regulation.
