El internamiento de las personas mayores en centros residenciales

Abstract

El Trabajo analiza la regulación internacional y española, así como la jurisprudencia y doctrina hasta la fecha, en lo que se refiere a la capacidad de las personas mayores para ingresar de manera voluntaria o involuntaria en centros residenciales, particularmente las garantías que deben cumplirse para su internamiento no voluntario, destacando las luces y sombras de la regulación actual que podrían afectar de manera directa a la protección de los más fundamentales derechos y libertades de las personas mayores, y reflexionándose sobre la praxis de los tribunales civiles a la luz de las recientes sentencias del Tribunal Constitucional, de cara a mejorar la legislación actual poniendo en el centro a las personas mayores.

The paper analyses the international and Spanish regulations, as well as the jurisprudence and doctrine to date, with regard to the capacity of the elderly to voluntarily or involuntarily enter residential centers, particularly the guarantees that must be complied with for non-voluntary internment, highlighting the lights and shadows of the current regulation that could directly affect the protection of the most fundamental rights and freedoms of the elderly, and reflecting on the praxis of the civil courts in the light of the recent rulings of the Constitutional Court, with a view to improving the current legislation by placing the elderly at the centre.
