Derechos de los Animales: Perspectivas Latinoamericanas

Abstract

El presente trabajo tiene como fin el análisis de las aportaciones más relevantes realizadas en el ámbito de los derechos de los animales, determinando el estado actual de la cuestión de los mismos en diferentes estados latinoamericanos. El mismo comienza realizando un repaso de las teorías más destacadas de los estudiosos de la materia, en aras de conjugar el marco teórico en el cual se mueve la doctrina, atendiendo a los criterios de reconocimiento de derechos a los animales. Una vez sentadas estas bases, pasan a analizarse sentencias concretas de Colombia, Argentina, y Ecuador, tratando de destacar lo novedoso y lo relevante de cada una de ellas.

This paper has the aim of analyzing the most relevant contributions of the Animal Law studies, determining the current status of this matter in different Latin American states. It begins presenting a review of the most notable judgements of the field, in order to establish the theoretical framework in which the doctrine is moving, attending to the criteria used to recognise animals as a subject of rights. Once this basis are sat, the paper starts analyzing concrete judgments ruled in Colombia, Argentina and Ecuador, trying to highlight the new and the relevant of each of them.
